Introduction

I have described the General Terms and Conditions in a particularly transparent and extremely detailed manner with regard to all possible situations, so that clear conditions are already in place in advance. However, if anything is not quite clear, please contact me.

General terms and conditions

1) Scope of application

These General Terms and Conditions (in short: GTC) apply between Ing. Peter Knopf, hereinafter referred to as “rebirther” and the following persons, hereinafter referred to as “rebirthee”:

a) users/readers of the website rebirthing.life
b) persons who communicate with the rebirther in writing or verbally by e-mail, telephone, text message, post or in person
c) persons who would like to book a rebirthing session with the rebirther, or have booked one, or are taking part in one, or have already taken part in one

These GTC always apply, unless another written agreement has been made and this change has been expressly agreed to by the rebirther by means of his signature. The rebirther reserves the right to change these terms and conditions at any time. The current GTC can always be found on the rebirthers website rebirthing.life. The current status is always indicated at the end of the GTC by day/month/year. The GTC (and also the data protection information) are saved to an e-mail address at the same time. This means that all old versions can be traced without gaps if necessary.

The GTC also apply in particular if the rebirthee has not signed the Declaration of Consent (e.g. during an initial telephone consultation) or has not yet signed it (e.g. on arrival).

2) Copyright

The texts on the rebirthing.life website are subject to the copyright of the rebirther. The texts may not be copied, reproduced, made available or published on other websites or in other electronic or printed media and publications. Any form of further use of the texts is not permitted without the express written consent of the rebirther.

Insofar as the texts on the rebirthing.life website were not created by the rebirther, the copyrights of third parties are respected. In particular, third-party texts are therefore marked as such. Should the user/reader of the rebirthing.life website nevertheless become aware of a copyright infringement, the rebirther asks for a corresponding notification using the contact options under the heading “Contact”. The rebirther will remove such content immediately upon becoming aware of any infringements.

The rebirther has acquired the private and commercial rights of use for the photos in which he himself is depicted. Any form of further use of these photos is not permitted without the express written consent of the rebirther.

The design of the Confirmation of Participation is also subject to the copyright of the rebirther. Any form of further use of the design is not permitted.

3) Service

The rebirther teaches the rebirthee how to use “connected breathing” and the best ways to do rebirthing on his own as quickly as possible. To learn the technique as well as possible, the rebirthee uses the breathing technique and the stuff he has been taught. The rebirther supports the rebirthee by sitting next to him and giving verbal instructions if necessary. This lesson is referred to below as a “rebirthing session” (or “individual rebirthing session”, or “session”).

The total duration of a rebirthing session is approximately two hours, with approximately one hour devoted to self-application of the technique and approximately one hour to the preliminary and follow-up discussions.
“Approximately” means plus or minus ½ hour. This applies to both the self-application and the preliminary and follow-up discussions. This means that both the self-application and the preliminary and follow-up discussions can last between ½ and 1 ½ hours. In the shortest case, a rebirthing session therefore lasts one hour and in the longest case three hours.
A specific end time can never be predicted due to emerging questions or energetic patterns. The rebirther therefore adapts completely to the respective situation of the rebirthee.

All content taught is based on the experiences and, accordingly, the individual perspective of the rebirther. It should be noted that the rebirther cannot guarantee or warrant that this information is always complete, accurate, and up to date. Guarantees and warranty claims are therefore completely excluded.

Furthermore, the rebirther shall not be liable for any direct and/or indirect damages of a material and/or immaterial nature that may arise from the use or non-use of the information provided, unless such damage was caused by intent and/or gross negligence on the part of the rebirther.

The rebirthee receives a certificate after completing eight rebirthing sessions within a maximum of seven months. If fewer than eight rebirthing sessions are completed within seven months, the rebirthee does not receive a certificate. On the certificate, the rebirther confirms with his signature that the rebirthee has completed the eight rebirthing sessions. If the rebirthee loses the certificate at a later date, the rebirther will issue a new certificate with the same data as the original. The certificate is not sent by e-mail, but must be collected in person from the rebirther. If the identity of the rebirthee cannot be clearly established, the certificate will only be issued on presentation of an official photo ID. Furthermore, it should be noted that the rebirther will only issue a new certificate as long as, firstly, he has a valid business license and, secondly, the rebirthee has not arranged for his data, including the scan of his certificate, to be permanently deleted for data protection reasons. Furthermore, the rebirther will issue a new certificate a maximum of once. The same applies to a new issue of the Declaration of Consent and/or the invoice. In the event of loss, the rebirthee will receive a printout of the registered Declaration of Consent and/or invoice a maximum of once, provided that the documents are still available (automatic deletion of the Declaration of Consent and the invoice after expiry of the specified deadlines). The documents must be collected in person and will only be handed over on presentation of an official photo ID if the identity of the applicant cannot be clearly established.

After completing the eighth session, the rebirthee also receives a script. Unlike the certificate, the script is not subject to any time limit. If the rebirthee therefore needs longer than seven months for the eight sessions, he will still receive the script after the eighth session. As with the certificate, the script will only be reissued once in the event of loss.

The rebirther reserves the right to change or completely discontinue his offers regarding the duration of rebirthing sessions at any time, unless one or more rebirthing sessions have already been paid for by the rebirthee.

4) Delimitations

Human energetics is a free trade with the trade license wording:

“Assistance in achieving physical or energetic balance” (source of the text: wko).

The rebirther acts in full accordance with this business license. The rebirthing technique serves to raise awareness and integrate energetic patterns (these are the energies in the body that arise when one devalues something). All statements made by the rebirther are to be understood as a description of these energies.

The rebirther makes it very clear that he is not a doctor, healer or therapist. The rebirther expressly states that he never associates rebirthing with “healing” and therefore does not make any promises of healing. The rebirthee is therefore explicitly advised that only a licensed health professional (doctor, therapist, psychologist …) may/can “heal”.

All information about rebirthing and the application of rebirthing therefore does not replace medical diagnosis and/or treatment. Should the rebirthee feel ill or be ill, the rebirther strongly recommends contacting a licensed healthcare professional as soon as possible. The decision to begin, continue or change any medical or therapeutic treatment is the sole responsibility of the licensed healthcare professional.

Furthermore: the rebirther does not diagnose illnesses, recommend or prescribe medications, or recommend suspending or stopping medications completely. Medication is only diagnosed, recommended and prescribed by a licensed healthcare professional.

And once again, to make it absolutely clear: rebirthing has nothing, absolutely nothing, to do with solving physical or psychological problems. If the rebirthee has any psychological problems (addictive behavior, burnout, anxiety, psychosomatic disorders, depression, traumatic experiences, panic attacks, etc.), or physical problems (asthma, lung diseases, epilepsy, circulatory or blood pressure problems, etc.), the rebirther clearly points out once again that this problem should be clarified and worked through with a licensed healthcare professional, in particular a doctor, psychiatrist, psychologist, or psychotherapist.

The rebirthee is hereby clearly informed that he must inform the rebirther before the start of a rebirthing session if he is receiving such services from a licensed professional. In this case, the rebirther will refuse the rebirthee. The only exception is if the rebirthee provides the rebirther with written confirmation from a licensed healthcare professional, clearly stating and signed, that the professional agrees to the rebirthing sessions.

5) Guarantees/warranties

Every person reacts differently to “connected breathing”, or the awareness of “energetic patterns”, or the “integration” of energetic patterns. Most people feel something, but some do not. Individual perceptions and reactions are therefore beyond the control of the rebirther.

Furthermore, it is not within the rebirther’s sphere of influence or responsibility what expectations the rebirthee has of a rebirthing session. The rebirther cannot therefore guarantee results or successes that are individually expected by the rebirthee.

The rebirther’s service is therefore exclusively the transfer of knowledge (most of which is already presented on this website), as well as his presence and, if necessary, verbal support while the rebirthee applies the technique to himself. The effect of a rebirthing session therefore depends solely on the rebirthee himself, whether and to what extent he wants to engage with himself. Guarantees and warranty claims are therefore completely excluded.

6) Responsibility

The rebirthee is responsible for determining whether he is physically and mentally capable of participating in a session. A session requires a “normal” physical and mental condition. “Normal” means that a person is able to carry out everyday activities independently and on his own responsibility without any significant limitations. If the rebirthee is unsure whether rebirthing is suitable for him, it is the sole responsibility of the rebirthee to clarify this with a licensed healthcare professional.

The rebirthee is also clearly informed that increased awareness of energetic patterns may lead to unpleasant sensations. Whether the rebirthee wishes to engage in this process or not is solely his responsibility. The rebirther cannot be held responsible for any possible worsening of physical and/or mental/emotional symptoms or for any direct and/or indirect damage of a material and/or immaterial nature during or after a session. Furthermore, the rebirthee is responsible for any application or non-application of rebirthing after a paid session with the rebirther. It is not the responsibility of the rebirther whether, how long, and in what form the rebirther applies the rebirthing technique, or how he communicates rebirthing in general or in detail to third parties. The rebirther explains his working methods and his views on rebirthing on this website in clear and understandable terms. Other explanations or working methods by the rebirthee are the sole responsibility of the rebirthee.

Furthermore, the rebirther cannot be held liable for any damage incurred by the rebirthee during his arrival or departure. The rebirthee is solely responsible for ensuring his safe arrival and departure. However, if the rebirthee suffers damage during the session on the rebirther’s premises (e.g., falling down the stairs, cat bite, etc.), the rebirther points out that he has taken out professional liability insurance, which will decide on the further course of action in the event of an incident. Whether, when, and how damages are compensated is neither within the rebirther’s sphere of influence, nor can he make any statements on this matter.

7) Payment

The price for the rebirthing session must be paid to the rebirther in advance. Either in cash before the start of the session or by bank transfer to the rebirther’s account. The amount must be credited to the rebirther’s account at least three working days before the start of the session. The account number will be sent to the rebirthee by e-mail or telephone. The rebirther reserves the right not to provide the account number to the rebirthee. In this case, only cash payment is possible.

In return, the rebirther will receive an invoice at the beginning of the rebirthing session confirming that the session has been paid for in cash or via the account.

The following applies to cash payments: the rebirther only accepts 10, 20, 50 and 100 euro banknotes. 200 and 500 euro banknotes are not accepted. Furthermore, no foreign currencies are accepted.

The price per session is 280,- euro
The discounted price for eight sessions is 2,000,- euro
The discounted price is only valid if paid in full before the first session.

The amounts listed are VAT-free due to the small business regulation.
If there is a possibility of full or partial reimbursement of the session price from the rebirthees health insurance or insurance company, it is the sole responsibility of the rebirthee to take care of these matters. The rebirther points out that he has no influence whatsoever on any reimbursement possibilities and does not carry these out for the rebirthee.

The rebirther reserves the right to change prices at any time. However, if a rebirthee has already agreed a appointment for a session with the rebirther, the price at the time of the appointment applies, regardless of whether the rebirther has changed the price between the time of the appointment and the start of the session. The price fixing applies for a maximum of one month from the date of appointment. If the appointment is made at a later date, the new price applies.
The same applies in the case of advance payment for eight sessions. In this case, the price fixing applies for seven months from participation in the first session. If the reduced price expires for one of the reasons mentioned in point 11, the new price applies thereafter.

8) Individual prices

On the one hand, the rebirther does not offer discounts for senior citizens or students, and on the other hand, no surcharges for high earners or millionaires. Every person is treated “equally” by the rebirther, regardless of their world view, their professional activity, religious beliefs or the thickness of their wallet, and accordingly there are only standardized prices.

The only exception is booking eight rebirthing sessions in advance, because this reduces the administrative workload for the rebirther. For this reason, everyone receives the same discount.

9) Booking rebirthing sessions

Appointments for sessions are agreed informally, either verbally or in writing, between the rebirther and the rebirthee. No signature or other special agreement or confirmation is required. Furthermore, the agreed appointment can be postponed by either party at any time. However, the rebirther will only accept a maximum of one postponement by the rebirthee, regardless of whether this postponement was caused by free decision, force majeure, or a third parties. If the rebirthee has already paid the reduced price in advance, a maximum of one appointment postponement per session applies. If the Rebirthee wishes to postpone a session more than once, the rebirthee will be refunded the amount already paid in advance for the remaining sessions, as described in point 11.

10) Participation requirements

At the beginning of the rebirthing session, the rebirthee receives a form (the “Declaration of Consent”) on which the rebirthee confirms with two signatures that he has read the General Terms and Conditions (signature 1) and the data protection information (signature 2) on the rebirthing.life website in full, that the contents are comprehensible and understandable for him, that there are no further questions and that he agrees with all contents. The following data is required on the Declaration of Consent: first name(s), last name, academic title(s) (if applicable), home address, e-mail address, telephone number and date. The rebirthing session cannot be started without signing the Declaration of Consent. The rebirthee undertakes to provide truthful information.

If the rebirthee takes part in further rebirthing sessions, he doesn´t have to sign a new Declaration of Consent each time. However, there are three cases in which the rebirthee must sign the Declaration of Consent again. Firstly, if the terms and conditions and/or data protection information have changed in the meantime. Second, if more than six months have passed between the last rebirthing session and the newly booked session. And third, if the rebirther and/or the rebirthee have a new name and/or a new residential address.

The rebirther reserves the right to refuse a rebirthee without giving reasons. In particular, if he has the impression that the rebirthee is under the influence of alcohol, drugs, psychotropic drugs or other substances that cloud or expand consciousness. Or if the rebirther suspects that the rebirthee is in some other unsuitable physical, emotional or mental state.

In order to participate in a rebirthing session, the rebirthee must also be of legal age. In case of doubt, the rebirthee must show the rebirther an official photo ID. If he is unable or unwilling to do so, the rebirther will not offer the rebirthing session to the rebirthee.

11) Cancellation policy

Until the Declaration of Consent is signed, both the rebirther and the rebirthee can cancel the appointment at no cost. In the case of a cash payment before the start of the rebirthing session, the rebirthee will be refunded the full amount immediately. In the case of an advance transfer to the rebirthers account, the rebirther will transfer the full amount back to the rebirthers account within three working days. An invoice that has already been issued and signed by the rebirther is therefore invalid and must be returned to the rebirther.

Once the Declaration of Consent has been signed and the invoice has been issued, the session fee is non-refundable, regardless of when the rebirthee ends the session (whether by free choice, due to force majeure, or through the fault of a third party – with exception of the rebirther).

Special agreements on the reduced price for eight rebirthing sessions:

It is agreed that no more than one month may elapse between two sessions. The maximum duration is therefore seven months. If the rebirthee allows more than one month to elapse between two sessions (whether by free choice, due to force majeure, or through the fault of a third party), the reduced price shall lapse and the rebirthee shall pay the rebirther an additional 240 euros before the next session (for a total of 2240 euros = 8 x 280 euros). A further invoice will of course be issued for the additional payment. If the rebirthee does not want this and would like to have the prepaid amount refunded, it is agreed that 280 euros can be charged for each session already completed and the difference to the 2,000 euros already paid will be transferred to the rebirthees account within three working days. Cash refunds are not possible. The invoice already issued is therefore invalid and must be returned to the rebirther. The rebirthee will then be issued a new, corrected invoice.
Specific calculation example: five sessions have been completed, 2,000 euros paid before the first session. Rebirthee waives the remaining three sessions. Rebirthee will therefore receive 600 euros [2000 – (5 x 280)] transferred to his account within three working days.
The same applies, of course, if the rebirthee does not wish to attend any further sessions without giving reasons.

If, conversely, the rebirther is unable to offer the next session within one month, the rebirthee will be refunded the reduced difference to their account within three working days. The invoice already issued is therefore invalid and must be returned to the rebirther. The rebirthee will then be issued a new, corrected invoice.
Specific calculation example: the rebirthee paid 2,000 euros, three sessions took place, but the rebirther is unable to attend the fourth session and therefore cannot conduct it within one month. Since one session costs 250 euros instead of 280 euros due to the reduced total price, the rebirthee has already paid 3 x 250 = 750 euros. The rebirthee will therefore be refunded 1,250 euros (5 sessions x 250 euros).

If the rebirthee does not agree with this and still wishes to continue with the remaining sessions, the reduced total price will remain in place and the rebirther will conduct the remaining sessions as quickly as possible. However, if six months have passed since the last session, the rebirthee will in any case be refunded the amount for the outstanding sessions. If the rebirthee then wishes to have a reduced price again, this is only possible with a total of eight sessions (= 2,000 euros).
If the rebirther ends a session prematurely (prematurely = before half the time has elapsed, as described in point 3, i.e. after 15 minutes in the preliminary discussion, or after ½ hour in the self-application – but not in the case of premature termination of the debriefing), the rebirthee will be refunded the full price for this session (280 euros for the individual price, or 250 euros for the reduced price), or a new replacement appointment will be arranged within one month. In the event of a refund for a single session, the invoice already issued shall be invalidated and returned to the rebirther. In the event of a refund for eight sessions already paid for in advance, the invoice shall also be returned and a new, corrected invoice shall be issued to the rebirthee.

In this context, it is also expressly pointed out that all costs incurred or to be incurred by the rebirthee in addition to the session price shall be borne by the rebirthee. The risk of complete or partial cancellation of a session by the rebirthee or by the rebirther, or that the rebirther rejects the rebirthee without giving reasons, is always borne by the rebirthee. All costs incurred or payments already made (e.g. travel costs, accommodation costs, etc.) can therefore not be charged to the rebirther.

12) Delays

The rebirther asks for punctuality at an agreed appointment. Punctuality is an important value for the rebirther because punctuality shows high esteem for the other person. The only exception is force majeure (e.g. traffic accident). Therefore, if it is foreseeable that the rebirthee will be more than ½ hour late due to force majeure, the agreed appointment is considered canceled and can be rescheduled once again (see point 9).

13) Image, film and sound recordings

Image, film and sound recordings are not permitted during the entire rebithing session, or sound recordings during telephone conversations, even if the recordings are only made for personal use. Violations will be reported to the police without exception.

Two exception for image recordings: firstly, image recordings are permitted if copies of the Declaration of Consent, the invoice and the certificate cannot be made due to technical problems with the photocopier. In this case, pictures of the three documents must be taken for the purpose of documentation for the rebirther. Secondly, if due to damage (see point 6) pictures of the damage must be taken for further steps for the insurance company.

14) Confidentiality

In any communication, especially during a rebirthing session, it is possible that personal information may be disclosed at your own request. However, this does not imply the conclusion that this information may then be passed on to other persons. It is therefore understood that neither the rebirther nor the rebirthee may disclose personal information to third parties.

15) Use of the rebirthing.life website

The rebirther checks all information provided on the rebirthing.life website at appropriate intervals to ensure that it is complete, correct and up-to-date. However, the rebirther cannot give any assurance or guarantee that the information is always complete, correct and up-to-date at “every” point in time. The rebirther is therefore not liable for any damages that may arise from the use or non-use of the information provided. Liabilities of any kind, guarantees and warranty claims are therefore completely excluded.

The rebirthing.life website contains cross-references (hyperlinks) to third-party websites. These cross-references are marked accordingly and open in a new window. The operators/providers of these websites are solely responsible for the content and compliance with data protection, as well as the technical freedom from interference or the risk of viruses, Trojans, etc. of these websites. The cross-references were checked for possible violations of applicable law at the time of linking. These were not recognizable at the time of linking. However, permanent monitoring of the content of the cross-references is not reasonable without concrete evidence of an infringement. Should the user/reader of the rebirthing.life website become aware of an infringement of the law, the rebirther asks for a corresponding notification using the contact options under the heading “Contact”. The rebirther will remove the cross-reference immediately upon becoming aware of any legal infringements.

The rebirther points out unequivocally that by merely making the hyperlinks available, he does not adopt the contents of third party websites as his own or wish to create the impression that the contents of third party websites originate from him. The rebirther has no influence on the content of third party websites, nor is he responsible for the information provided at any given time. For incomplete, incorrect or illegal content, as well as for damages resulting from the use or non-use of information from third-party websites, the operator/provider of the website to which reference is made is solely liable. The use of cross-references is therefore always at the user’s/reader’s own risk on the rebirthing.life website.

If operators/providers of third-party websites wish to make a cross-reference from their website to the rebirthing.life website, written consent from the rebirther is required in advance.

Furthermore: nor does the rebirther guarantee that the rebirthing.life website will be available at all times or that it will be free from technical faults. Liabilities of any kind, guarantees and warranty claims are therefore completely excluded.

And as a final point: the rebirther expressly reserves the right to change, supplement or delete the contents of the rebirthing.life website in part or in full at any time without prior notice, or to temporarily or permanently cease publication of the rebirthing.life website.

16) Use of the contact options

The rebirthee can contact the rebirther using the technical possibilities available today. This can be done in writing (e-mail, SMS, post) or verbally (telephone). In this context, the rebirther clearly points out that even with the utmost care, e-mails can be hacked, telephones tapped and letters opened. If the rebirthee has concerns and worries about this (in particular with regard to data protection), the rebirther recommends that the rebirthee does not use these communication channels.

Furthermore, the following is hereby clearly and unambiguously pointed out: the disclosure of the contact options does not authorize the unsolicited sending of advertising information/materials, Spam and the like, as well as for business initiation of any kind. The sending of advertising information/materials, Spam and the like, as well as for business initiation of any kind, regardless of the communication channel, is hereby expressly prohibited. In this context, the contact details of the rebirther are also entered in the ECG and Robinson list. In the event of non-compliance, the rebirther reserves the right to take immediate legal action.

The contact options may therefore only be used by the following persons and institutions:

a) Rebirthees who wish to make use of the services offered by the rebirther
b) Persons and institutions who wish to work with the rebirther to promote awareness of rebirthing in the world, provided that this does not incur any costs for the rebirther
c) Institutions (authorities, courts and the like) that must contact the rebirther on a legal basis

17) Applicable law and place of jurisdiction

The GTC are subject to Austrian law.

The place of jurisdiction is the court in Vienna, which has local and subject-matter jurisdiction.

18) Dispute resolution

Consumers have the option of submitting complaints to the European Commission’s online dispute resolution service:

However, it should be noted that traders are generally not obliged to participate in a dispute resolution procedure.

19) Final provision / severability clause

Should parts of the GTC be or become invalid, this shall not affect the remaining provisions. All other provisions shall remain in force.
